The practical answer still depends on four questions:

1. Do the particular documents permit the intended service method?
2. Can the recipient be lawfully approached at that location?
3. Can the recipient or substitute recipient be reliably identified?
4. Will all required follow-up steps be completed correctly?

A Saturday attempt does not validate service on the wrong person. A Sunday attempt does not allow entry into a private residence. Electronic filing systems may accept documents outside ordinary counter hours, but the filing date and processing rules depend on the court, case type, filing provider, and submission time. Do not assume that a Saturday upload will be treated as a Saturday court filing.

Holiday service can be strategically useful when reliable information shows that the recipient will be present. It can also be counterproductive when:

Saturday Morning

Saturday morning can be effective for recipients who work standard weekday hours. It may also allow a second attempt later in the weekend if the first report produces useful information.

Saturday Afternoon or Early Evening

This window may reach people returning from errands, children’s activities, work, or travel. The server should vary timing based on prior observations rather than repeatedly arriving at the same hour.

Sunday Morning

Sunday morning may find some residents home, but it can conflict with religious services or family routines. A later attempt may be more discreet and productive unless the client has specific availability information.

Sunday Afternoon or Early Evening

This is often a practical residential window before the workweek begins. The server should still avoid unreasonable late-night contact and consider whether lighting, access, or neighborhood conditions create a safety concern.

Is There a Legal Earliest or Latest Hour?

California’s general personal-service statute does not establish one statewide hourly window for every civil document. That does not make every hour appropriate. Local rules, property policies, document-specific requirements, court orders, noise restrictions, and safety considerations may affect the attempt.

A process server should avoid extremely early or late residential contact unless the assignment, deadline, and verified schedule justify it. Repeated nighttime visits designed to frighten or pressure someone can create unnecessary risk and weaken the professionalism of the service record.

Personal and Substituted Service on Weekends

The weekend does not change the difference between personal service and substituted service.

Weekend Personal Service

Personal service is complete when the required documents are personally delivered to the correct recipient under Code of Civil Procedure section 415.10. If delivery occurs at 2:30 p.m. on Sunday, the Proof of Service should state that actual Sunday date and time.

The recipient does not necessarily defeat service by refusing to hold the packet. If the server reliably identifies the person, clearly explains that legal documents are being served, and uses a legally appropriate refusal procedure, delivery may still be completed. The server should describe the identification, statements, refusal, and placement of the documents.

Weekend Substituted Service

For a California civil summons, substituted service on an individual may be available after the person cannot be personally served with reasonable diligence. The packet may be left at a qualifying residence, place of business, or usual mailing address with an appropriate adult recipient who is informed of its contents. Another copy must then be mailed as required by the operative statute.

A Sunday delivery to a qualifying household member does not eliminate the mailing step. The process server must record the delivery and mailing separately. Under the version of section 415.20 operative during 2026, substituted service is generally complete on the tenth day after mailing, not at the moment the substitute recipient receives the papers.

Because statutory amendments are scheduled for 2027, clients should confirm the law in effect on the date of any later substituted service.

Weekend Delivery to a Child

Weekend availability does not allow the packet to be left with a young child. Substituted service at a residence generally requires a competent household member who is at least 18 years old. The server should verify age and household status rather than making assumptions.

Leaving Papers at the Door

Where Can Weekend Service Take Place?

At a Residence

A verified residence is the most common weekend location. The server should confirm the complete address, unit, recipient identity, and any gate or access information. Vehicles, lights, sounds, packages, or movement may help plan another attempt, but they do not independently prove that the recipient is home.

At an Apartment or Condominium

Weekend staffing may differ from weekday staffing. A leasing office may be open Saturday but closed Sunday. A concierge may control lobby access without being authorized to accept the recipient’s papers.

California Code of Civil Procedure section 415.21 may require a staffed covered apartment or condominium property to grant a qualifying process server reasonable access after the required identification and credentials are displayed. Workplace service may be possible on a weekend when the business is open and the recipient is working. Restaurants, hotels, retail stores, hospitals, entertainment venues, warehouses, and emergency services often operate outside the Monday-through-Friday schedule.

The server should confirm identity, comply with lawful access restrictions, and act discreetly. A supervisor, receptionist, or security officer is not automatically authorized to accept documents personally for an employee.

At a Registered Agent Office

Corporations and LLCs are often served through a designated agent. Professional registered-agent offices typically publish business intake hours and may be closed on weekends. Arriving at a locked office on Sunday may document an attempt but is unlikely to complete delivery.

If a business deadline is approaching, verify agent hours before ordering weekend dispatch. Another qualifying corporate recipient or method may exist, but the client should review the applicable statute rather than instructing the server to leave papers outside.

At a Public Location

Personal service can sometimes be completed in a lawful public setting when the recipient is reliably identified. The process server should avoid creating a scene, revealing unnecessary case details, or interfering with emergency care, employment duties, religious observance, or a protected proceeding.

At a Jail, Hospital, or Military Installation

These locations may operate every day but have controlled service procedures. Weekend access, visitor hours, patient privacy, custody rules, and authorized intake personnel vary. Contact the facility and obtain current instructions before dispatch.

How Does Weekend Service Affect Court Deadlines?

The service date and the last day to respond or file are separate questions. Personal service may be complete on Saturday or Sunday even though the court is closed.

Actual Service Date

For personal delivery of a California summons under section 415.10, service is complete at the time of delivery. The proof should not change a Sunday service date to Monday for convenience.

Counting the Response Period

California Code of Civil Procedure section 12 generally excludes the first day and includes the last day when calculating a statutory period, unless another rule applies. Section 12a provides that when the final day for an act falls on a holiday, the period extends to the next day that is not a holiday.

For purposes of section 12a, Saturday is treated as a holiday. Government Code section 6700 identifies every Sunday and various named public holidays as state holidays. Document-specific statutes and California Rules of Court may use calendar days, court days, or another counting method.

As a result:

• A weekend can be the valid service date
• The following day may be the first counted day under the applicable calculation rule
• Calendar days may include weekends during the middle of the period
• Court-day calculations exclude days the court is closed
• A final day falling on a qualifying holiday may move to the next nonholiday

Do not calculate a response deadline using a general online calculator without selecting the correct jurisdiction, document, method, and type of days. A summons, subpoena, restraining-order hearing, motion, discovery request, and eviction case can use different rules.

Advance-Service Deadlines

Some papers must be served a specified period before a hearing, deposition, trial, or compliance date. A weekend attempt near the end of that period may be too late even if delivery itself is lawful. The process server needs the actual last permissible service date from the attorney or client.

Substituted-Service Completion

When the method requires both delivery and mailing, the completion date may be tied to the mailing rather than the first physical handoff. The legal team should calculate subsequent deadlines from the statutory completion date, not simply from the Sunday when papers were left with a household member.

Does Weekend Service Cost More?

It can. A weekend attempt may be included in a standard assignment when the provider varies attempt times across the week. A client-requested Saturday, Sunday, holiday, same-day, or last-minute dispatch may require rush or emergency pricing.

The quote may be affected by:

• How quickly the first attempt must begin
• Whether a particular Saturday or Sunday window is required
• Distance and travel time
• Number of recipients and addresses
• Gated or restricted property access

Ask whether the fee covers a weekend attempt or only weekend intake. Same-day service usually means priority review and dispatch, not guaranteed successful delivery that day.

What Happens After an Unsuccessful Weekend Attempt?

A failed weekend attempt should produce useful information, not only “no answer.” The report should help the client decide whether another weekend visit, a weekday attempt, a workplace attempt, or address research makes sense.

A useful report may include:

• Date and exact time
• Complete address and unit
• Whether the server reached the door
• Gate, callbox, lobby, or security conditions
• Names or descriptions of people contacted
• Statements about the recipient’s residence or schedule

Should the Server Return at the Same Time Next Weekend?

Usually not without a reason. If Saturday at 10:00 a.m. produced no contact, repeating the identical window may add little. A later Saturday attempt, Sunday afternoon, early weekday attempt, workplace visit, or verified alternate address may be more productive.

Does One Weekend Attempt Establish Reasonable Diligence?

Not automatically. California does not use one universal number of attempts for every document and alternative method. Reasonable diligence is evaluated through the quality, timing, variety, and circumstances of the efforts.

If a current resident, manager, or neighbor provides reliable information that the recipient moved, repeatedly returning on weekends may waste the remaining service period. The client should verify the address or consider skip tracing and alternate-address research.

How to Prepare a Saturday or Sunday Assignment

Weekend dispatch is most effective when the process server receives the complete assignment before the requested window.

Provide:

• The complete finalized service packet
• The recipient’s full legal name and known aliases
• The complete address, including unit or suite
• The exact service deadline and hearing date
• The document and case type
• Any court order or special service instruction
• A recent photograph or physical description
• Known weekend schedule or expected availability

Prior personal attempts satisfy the applicable diligence requirement, and the documents permit substituted service. A competent household member at least 18 accepts the packet on Saturday and is informed of its contents. The required mailing is completed and documented. Scenario 4: Sunday Attempt at a Closed Business

The defendant is a corporation whose registered-agent office accepts process only on weekdays. The Sunday visit finds a locked suite. The server reports the posted hours rather than leaving the papers outside. The client schedules an attempt during the agent’s business hours.
